Your agreement to comply with these Terms and Conditions is indicated by your use of Our Site. If you do not agree to these Terms and Conditions, you must stop using Our Site immediately.

2. Terminology

In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:

  • “Company”, “We”, “Us”, “Our” refers to GradeSpike.
  • “Client”, “You”, “Your” refers to any user accessing Our Site, including Admins, Teachers, Parents, and Students.
  • “Teacher / Tutor” refers to an individual authorized by Us to deliver live online educational sessions.
  • “Parent / Student” refers to users registered to purchase or receive tutoring services.
  • “Services” refers to online tuition scheduling, educational tools, and video coordination provided via Our Site.

3. Site Usage & User Roles

Our platform accommodates distinct user roles, each subject to specific responsibilities:

  • Admin: Holds system oversight for account verification, platform moderation, and operational management.
  • Teachers: Must provide accurate credentials, deliver online sessions professionally, and maintain student confidentiality.
  • Parents & Students: Must maintain updated contact details, ensure punctual attendance for scheduled sessions, and ensure account safety.

You agree not to share account login credentials outside your authorized household or misuse any communication tools provided on the platform.

4. Payments and Advance Billing

All tuition fees must be paid strictly in advance prior to the start of any scheduled session or billing cycle.

Failure to complete payment in advance will result in automatic withholding of class access and temporary suspension of session links. All transactions processed through payment gateways integrated into Our Site are secured and billed according to the agreed tutoring tier or package selected.

5. Class Scheduling, Rescheduling, and Cancellations

Class schedules are agreed upon at the time of booking. Rescheduling of any session is subject to mutual agreement from all participating parties (Teacher, Parent/Student, and Admin where applicable).

  • Rescheduling requests must be submitted through the portal at least 24 hours prior to the scheduled start time.
  • If a session cannot be rescheduled by mutual consent, standard cancellation policies apply.
  • If a Teacher cancels or fails to attend a session without prior notice, a makeup session will be arranged at no extra charge.

6. Refund Policy

Because payments are made in advance, refunds are handled strictly under the following conditions:

  • Full Refunds: Eligible if requested within 48 hours of initial payment and prior to attending any live sessions.
  • Pro-rated Refunds: Granted if GradeSpike is unable to provide a replacement tutor due to unresolvable service disruptions.
  • Non-refundable: Missed sessions without prior 24-hour mutual rescheduling notice are non-refundable.

7. Third-Party Services (Live Sessions)

Our Site integrates third-party applications (including, but not limited to, Zoom, Xoom, or equivalent software) to host live online video tutoring sessions.

By participating in live sessions, you agree to comply with the terms of service and privacy rules of those third-party providers. GradeSpike is not responsible for performance degradation, connectivity failures, or security disruptions originating from third-party hosting networks.

8. Intellectual Property

All content, branding, code, page layouts, and underlying software on Our Site belong to or are licensed to GradeSpike.

Educational resources uploaded by Teachers remain their intellectual property but are licensed to Us for platform use. Users may not copy, distribute, record, or re-sell session videos or instructional material without explicit written permission.

9. Limitation of Liability

To the fullest extent permitted by law, GradeSpike shall not be liable for any indirect, consequential, or incidental damages resulting from site downtime, lost connectivity, or third-party software failures.
